These general terms and conditions (hereinafter GTC) apply to the online shop at www.wand-magie.ch (hereinafter online shop). The operator of the online shop is: SANTANA HERNANDEZ Webshops, Zurlindenstrasse 21 8003 Zurich.

The provider may change these terms and conditions at any time. The version of these GTC applicable at the time the contract is concluded is decisive. Deviating conditions of the customer are not recognized.

1. General

The offer is aimed exclusively at people residing or domiciled in Switzerland. Shipping is only to addresses in Switzerland.

The pictorial representation of the products serves as an illustration and is non-binding.

2. Shipping

To source our products, we work with suppliers around the world. Our suppliers typically ship items within one to five days of receiving an order. From this point it takes 20 - 25 days for the items to arrive. As soon as your product ships, you'll receive a tracking number so you can keep track of your order's location at all times.

The customer's delivery address must be easily accessible for the delivery service, otherwise the customer bears the additional costs resulting from the delivery.

It is at the discretion of the provider whether the order is sent in one or more packages or as a letter.

3. Availability

The offers in the online shop are subject to change and are not to be understood as binding offers. The information on availability and delivery time is given without guarantee and can change at any time.

4. Prices

The prices displayed in the online shop represent the prices actually to be paid. They include value added tax, any passed-through public taxes, copyright remuneration, early disposal fees and other surcharges of any kind that cannot be freely chosen.

The provider reserves the right to change the prices published in the online shop at any time. The price at the time of the order is decisive for the purchase price.

5. Conclusion of contract

If the customer orders an item in the online shop, he submits an application for the conclusion of a purchase contract to the provider. Once the application has been received by the provider, the customer will receive an automated confirmation of receipt. This confirmation does not yet represent acceptance of the application by the provider and does not contain any promise that the item can actually be delivered. The purchase contract is concluded when the provider confirms the order and issues the invoice to the customer.

Shipping costs are included in the price.

7. Obligation to check and give notice of defects

Transport damage must be reported to the provider.

The customer checks the goods for completeness, correctness and damage immediately upon receipt. The customer must report defects within 5 days of receipt. In this case, he may not put the goods into operation and must keep the original packaging. If the complaint is recognized by the provider, the customer must follow the provider's instructions for return.

8. Right of return

Purchased unused items can be returned within 14 days (hereinafter return period) from receipt by the customer. To do this, the customer must explain the return to the provider within the return period and send the goods back to the provider.The goods must be returned with all accessories and in the original packaging. The deadline is met if the goods are properly packaged and franked and handed over to Swiss Post within the return period. The customer bears the costs of the return. If the return has been declared and processed in good time, the provider will reimburse the customer for the purchase price.

9. Payment

The customer must make the payments in Swiss francs. The following payment options are available to the customer:

Credit card, Twint, Paypal

The items delivered by the provider remain the property of the provider until full payment has been made. The provider is entitled to make an entry in the retention of title register.

10. Disclaimer

The provider is not liable for slight negligence, for consequential damage, for indirect damage, for lost profit or for the actions of his assistants.

11. Privacy Policy

The processing of personal data is regulated in the separate data protection declaration (www.wand-magie.ch/datenschutz). This is part of these terms and conditions.

12. Severability clause

Should a provision of this contract be or become invalid or should there be a gap in the contract, the legal validity of the remaining provisions shall remain unaffected. In place of the missing or ineffective provision, a provision shall be deemed to have been agreed which comes closest to the economic purpose originally intended by the parties.

13. Force Majeure

In the event of special events such as riots, large-scale strikes, civil unrest, natural disasters, etc., the affected party is only liable to the other party for damage that can be proven not to be related to these events.

15. Place of jurisdiction and applicable law

This contract is subject to Swiss law to the exclusion of the United Nations Convention on the International Sale of Goods (UN Sales Convention).

The following exclusive areas of responsibility are agreed for all disputes arising from this contract:

In the case of a complaint by a consumer, the ordinary courts at the domicile or habitual residence of the consumer or at the registered office of the provider have jurisdiction.

In all other cases, the jurisdiction of the ordinary courts in Zurich is agreed.
